Terms of Service

1. Agreement to Terms

Welcome to Yod ("we," "us," or "our"). By accessing or using the Yod mobile application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

• Acceptance: By creating an account or using the Service, you accept these Terms
• Updates: We may modify these Terms at any time with notice
• Eligibility: You must be at least 17 years old to use Yod
• Binding Agreement: These Terms form a legal contract between you and Yod

2. Eligibility

To use Yod, you must:

• Be at least 17 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned from Yod
• Provide accurate and complete registration information

3. Account Security

• One Account: You may only create one account
• Accurate Information: You must provide truthful information, including birth date and location
• Account Security: You are responsible for maintaining the security of your account
• Unauthorized Use: Notify us immediately if you suspect unauthorized access
• No Sharing: Do not share your account credentials with others

4. User Conduct

4.1 Prohibited Activities

You agree NOT to:

• Harass, bully, or threaten other users
• Post explicit, violent, hateful, or illegal content
• Impersonate others or create fake accounts
• Spam or send unsolicited commercial messages
• Use the Service for illegal purposes
• Attempt to hack, reverse engineer, or compromise the Service
• Scrape or collect user data without permission
• Violate others' intellectual property rights
• Use automated systems (bots) without authorization
• Interfere with Service operation or other users' experience

4.2 Content You Post

• Your Responsibility: You are solely responsible for content you post
• License Grant: You grant Yod a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content
• Content Removal: We may remove content that violates these Terms
• No Guarantee: We do not guarantee storage or backup of your content

5. Location Services

• Background Location: Location tracking enables proximity-based matching features
• Opt-In Required: Location tracking requires explicit permission
• Control: You can disable location services at any time in settings
• Accuracy: Location data may not always be accurate
• Privacy: Location use is governed by our Privacy Policy

6. Intellectual Property

• Yod Ownership: All Service content, features, and functionality are owned by Yod or its licensors
• Trademarks: Yod name, logo, and marks are our property
• Limited License: We grant you a limited, non-exclusive, non-transferable license to use the Service
• Restrictions: You may not copy, modify, or create derivative works from the Service

7. Subscriptions and Payments

• Free Access: Basic features are available for free
• Premium Features: Additional features may be offered through in-app purchases
• Payment Processing: Payments are processed through Apple App Store or Google Play Store
• Refunds: Refund policies are governed by the respective app stores
• Price Changes: We reserve the right to change pricing with notice

8. Termination

8.1 By You

• You may delete your account at any time through the app settings
• Deletion is permanent and cannot be undone
• Some information may be retained as required by law

8.2 By Us

• We may suspend or terminate your account for violating these Terms
• We may terminate accounts for any reason with notice
• Serious violations may result in immediate termination without notice
• You will not receive refunds for any paid features upon termination

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Yod is not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to $100 or the amount you paid us in the last 12 months, whichever is greater
• We are not liable for user actions or interactions
• We are not responsible for data loss or security breaches beyond our control

11. Indemnification

You agree to indemnify and hold Yod harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of others' rights
• Content you post on the Service

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing a claim, you agree to contact us at t@mrcto.ai to attempt informal resolution.

12.2 Binding Arbitration

• Disputes will be resolved through binding arbitration, not in court
• Arbitration will be conducted under the American Arbitration Association rules
• Arbitration will take place in Michigan, United States
• The arbitrator's decision is final and binding

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class arbitrations.

12.4 Exceptions

Either party may seek injunctive relief in court for intellectual property violations.

13. Governing Law

• These Terms are governed by the laws of Michigan, United States
• Excluding conflict of law principles
• Federal arbitration law applies to the arbitration agreement

14. Changes to Terms

• We may modify these Terms at any time
• Material changes will be notified through the app or email
• Continued use after changes constitutes acceptance
• Current Terms are always available in the app

15. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Yod, you also agree to our Privacy Policy.

16. Safety and Conduct

• Meeting Users: Exercise caution when meeting users in person
• Personal Information: Do not share sensitive personal information
• Report Violations: Report suspicious or abusive behavior immediately
• Emergency: Contact local authorities in case of emergency

17. Third-Party Services

• The Service may contain links to third-party websites or services
• We are not responsible for third-party content or practices
• Third-party terms and privacy policies apply to their services

18. Export Controls

You agree not to export or re-export the Service in violation of U.S. export laws and regulations.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

20. Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Yod.

21. No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

22. Assignment

You may not assign these Terms. We may assign these Terms to any successor or affiliate.
